| BIMCO U.S. Census Bureau Mandatory Automated Export System (AES) Clause for Voyage Charter Parties (a) If the Vessel loads cargo in any US port or place, the Owners shall comply with the current US Census Bureau Regulations (15 CFR 30) or any subsequent amendments thereto and shall undertake the role of carrier for the purposes of such regulations and shall, in their own name, time and expense: (b) The Charterers shall provide all necessary information, to the Owners and/or their agents to enable the Owners to submit a timely and accurate export ocean manifest by AES. (c) The Charterers shall assume liability for and shall indemnify, defend and hold harmless the Owners against any loss and/or damage whatsoever (including consequential loss and/or damage) and/or any expenses, fines, penalties and all other claims of whatsoever nature, including but not limited to legal costs, arising from the Charterers’failure to comply with any of the provisions of this sub-clause. Should such failure result in any delay then, notwithstanding any provision in this Charter Party to the contrary, all time used or lost shall count as laytime or, if the Vessel is already on demurrage, time on demurrage. (d) The Owners shall assume liability for and shall indemnify, defend and hold harmless the Charterers against any loss and/or damage whatsoever (including consequential loss and/or damage) and any expenses, fines, penalties and all other claims of whatsoever nature, including but not limited to legal costs, arising from the Owners’ failure to comply withany of the provisions of sub-clause (a). Should such failure result in any delay then, notwithstanding any provision in this Charter Party to the contrary, all time used or lost shall not count as laytime or, if the Vessel is already on demurrage, time on demurrage. (e) The assumption of the role of carrier by the Owners pursuant to this Clause and for the purpose of the US Census Bureau Regulations (15 CFR 30) shall be without prejudice to the identity of carrier under any bill of lading, other contract, law or regulation. |

| BIMCO 항해용선계약을 위한 미국 센서스국 의무자동화수출시스템약관 (a) 선박이 미국 항구나 장소에서 화물을 선적할 경우, 선박소유자는 현행 미국센서스국규정(연방규정 법전 제15편, 제30조항)이나 그것에 대한 후속개정 등을 준수하여야 하고, 그러한 규정의 목적을 위해 운송인의 역할을 담당하여야 하고, 자기 자신의 이름, 시간, 경비로 다음을 수행하여야 한다. i) SCAC(표준운송인알파코드)를 발급하여야 한다. ii) ICB(국제운송인증권)를 발급하여야 한다. iii) 미국 센서스국에 AES(자동수출시스템)에 의해 수출해상적하목록을 제출해야 한다. (b) 항해용선자는 선박소유자가 적시에 그리고 정확하게 AES(자동수출시스템)에 의해 수출해상적하목록을 제출할 수 있도록 선박소유자 그리고/혹은 선박소유자의 대리점에게 모든 필요한 정보를 제공하여야 한다. (c) 하위조항 규정들의 어떤 것을 준수하지 않은 항해용선자의 실패로부터 발생하는 모든 손실 그리고/혹은 손상(간접 손실 그리고/혹은 손상을 포함하여) 그리고/혹은 경비, 벌금, 위약금, 그리고 법적비용에 국한되지 않고 포함하여 모든 성격의 모든 다른 청구권 등에 대하여 용선자가 선박소유자에 대하여 책임을 지고, 선박소유자에게 배상하여야 하고, 선박소유자를 변호하여야 하고, 선박소유자를 면책하여야 한다. 그러한 실패가 지연으로 귀결될 경우, 본 용선계약에서 정반대의 규정에도 불구하고, 사용되거나 상실된 모든 시간은 정박기간으로, 만약 선박이 이미 체선상태라면, 체선료 계산시 정박기간으로 산정된다. ◇해설 또한 항해용선자는 선박소유자가 시간 내에 규정을 준수하도록 화물에 관한 필요한 정보를 제공하여야 한다. 항해용선자의 실패로 손해가 발생하면 항해용선자가 책임을 져야하고 지연이 발생하면 지연된 시간은 정박기간으로 산정되고, 선박소유자의 실패로 손해가 발생하면 선박소유자가 책임을 져야하고 지연이 발생하면 지연된 시간은 정박기간으로 산정되지 않는다. 그리고 본 약관에서 선박소유자가 운송인의 역할을 담당하는 것은 다른 규정에 의하여 정하여지는 운송인의 정체성에 영향을 미치지 않는다.
지난 주 정기용선계약을 위한 미국 센서스국 의무자동화수출시스템약관에 대하여 검토하였고 이번 주에는 항해용선계약을 위한 미국 센서스국 의무자동화수출시스템약관에 대하여 검토한다. 본 약관에 의하면 정기용선계약을 위한 미국 센서스국 의무자동화수출시스템약관에서는 정기용선자가 운송인으로서 본 약관의 의무이행자가 되나 항해용선계약을 위한 미국 센서스국 의무자동화수출시스템약관에서는 선박소유자가 운송인이므로 의무이행자는 선박소유자가 된다.
