BIMCO Cleaning of Cargo Compartments Clause

Upon completion of discharge of each cargo, the crew shall render customary assistance in cleaning all cargo compartments in preparation for the next cargo, if required by the Charterers and if not prevented by any regulations or agreement whatsoever. Such cleaning work shall be performed while the Vessel is en route to next loading port, provided that this can be safely done and that the duration of voyage is sufficient. The Charterers shall pay to the Owners ○○(negotiable lumpsum) each time such cleaning is performed. The Owners will endeavour to effect such cleaning as best possible, but without any guarantee that the cargo holds will be sufficiently cleaned and accepted on arrival at the loading port and the Owners shall not be responsible for any consequences arising from the fact that the crew has been employed in cleaning.

BIMCO 선창청소약관

◇해설
본 약관은 정기용선계약의 협상 시 주요사항에 해당한다. 선박이 항해 중 선원이 선창을 청소하여 주고 선창청소(in lieu of hold cleaning)의 비용으로 합의된 금액을 정기용선자가 선박소유자에게 지급한다. 그러나 선적항에서 선적검사에 통과되지 아니하는 경우 등 청소의 상태가 미미하여 발생하는 결과에 대하여 선박소유자는 책임을 지지 않는다.

BIMCO Hold Cleaning/Residue Disposal Clause For Time Charter Parties

a) The Charterers may request the Owners to direct the crew to sweep and/or wash and/or clean the holds between voyages and/or between cargoes against payment at the rate of ○○ per hold, provided the crew is able safely to undertake such work and is allowed to do so by local regulations. In connection with any such operation the Owners shall not be responsible if the Vessel's holds are not accepted or passed. Time for cleaning shall be for the Charterers’ account.
b) All materials (including chemicals and detergents) required for cleaning of cargo holds shall be supplied by and paid for by the Charterers.
c) Throughout the currency of this Charter Party and at redelivery, the Charterers shall remain responsible for all costs and time, including deviation, if any, associated with the removal and disposal of cargo related residues and/or hold washing water and/or chemicals and detergents and/or waste as defined by MARPOL Annex V, Section 1 or other applicable rules relating to the disposal of such substances.

b) 선창의 청소에 필요한 모든 재료들(화학물질과 세척제를 포함하여)은 정기용선자에 의해 공급되어야 하고, 지급되어야 한다.
c) 본 용선계약의 유효기간 동안에, 그리고 반선 시에, 그러한 물질들의 처리에 관해, MARPOL(해양오염방지협약) 부속서 V 제1조 혹은 다른 적용이 가능한 규칙들에 의해 정의된, 화물 관련 잔류물 그리고/혹은 선창 세척용수 그리고/혹은 화학물질 그리고/혹은 세척제 그리고/혹은 폐기물 등의 제거 및 처리와 연관되고, 이로를 포함한, 모든 비용과 시간에 대하여, 발생할 경우에 정기용선자는 계속해서 책임을 져야 한다.

◇해설
선원이 항해 중 한 선창청소로 인하여 발생한 쓰레기를 임의로 수거할 장치가 항구에 없는 경우가 있다. 일부 선박은 선박구조상 선창 측면이나 빌지탱크에 이러한 쓰레기를 저장할 수 없기 때문에 항구에서 허락된 구역에서 쓰레기를 처분하는데 발생한 비용과 시간은 정기용선자가 부담한다고 본 약관은 규정하였다. 본 약관은 BIMCO 선창청소약관의 내용과 비교할 때, 청소에 필요한 재료는 정기용선자가 구입하여 지급하며, 청소 후 그 처분에 있어서도 정기용선자의 비용과 시간으로 한다는 내용을 추가한 것이 특징이다.
